Registration and Term of Registration
The Trademarks Office issues a registration and a certificate. The current term for a registration is fifteen (15) years. No actions are required from the applicant in the interim.
Challenge to Registration For Non-Use
The most common challenge to a registration is through a Section 45 proceeding, wherein the applicant must prove use within the past three years. Only the registrant can submit evidence, which is done by affidavit. Cross examinations are not permitted. If the Registrar is not satisfied, the registration will be expunged. Such an action cannot be taken until three years after the registration.
